Term. Service Provider will provide the above Services every two months, at a date and time to be mutually agreed upon between Service Provider and Customer, until this Agreement is terminated. Either Party may terminate this Agreement by notifying the other Party prior to the next scheduled Service.

Services. The terms of the Services such as target pest, frequency of service, and price are subject to change and will be negotiated as needed. Service Provider may rotate the serviced area between the interior, the exterior, and underneath the building as it deems necessary.

Retreatment. If any Covered Pest reoccurs within 30 days after Service, Service Provider will retreat the affected areas at no charge a maximum of three times per two-month period.

Covered Pests include:

• Ants, Crickets, Centipedes, Earwigs, Fire Ants, Fleas, Ladybugs, Millipedes, Pill Bugs, Roaches, Rodents, Silverfish, Spiders, Stinging Insects, and Ticks. 

Payment. Payment is due upon completion of each Service and may be made either by credit card, cash, or by check made payable to Empirical Pest Control, LLC.

Limitation of Liability. 

• I understand that Empirical Pest Control, LLC will not be held responsible for bites or damage to a person caused by spiders or any other insect or pest.

• I understand that Empirical Pest Control, LLC’s liability under this contract is limited to retreatment and refund of my last monthly pest control payment. 

• I understand that Empirical Pest Control, LLC is not responsible for any damage, including to structures or their contents, caused by wood-destroying organisms or other pests. 

I agree that under this contract, Empirical Pest Control, LLC is not responsible for the repair of any damages caused by pests to be treated under this contract. I also agree to allow Empirical Pest Control, LLC access to the premises for the purpose contemplated by this contract and to take all necessary steps to correct conditions which are conducive to the breeding and harborage of pests covered by this contract to ensure effective results. I acknowledge receipt of a signed copy of this contract.

BUYER’S RIGHT TO CANCEL: If this agreement was solicited at your residence and you do not want the goods or services, you may cancel this agreement by mailing a notice to the seller. The notice must say that you do not want the goods or services and must be mailed before 12 o’clock midnight (12:00) of the third business day after you sign this agreement.
